Terms & Conditions – Popcorn & Candy Floss Machine Hire

By placing an order for the hire of a popcorn machine, candy floss machine, or related equipment (“Equipment”) with CADENCE CAMPS (“we”, “us”, “our”), the customer (“you”, “your”) confirms that they have read, understood and agreed to these Terms & Conditions.
These Terms & Conditions apply to all equipment hire bookings made through our website, social media, telephone, email or any other booking method.
1. Booking & Payment
1.1 Your booking is only confirmed once we have received the required payment and have confirmed your booking.
1.2 The person making the booking must be aged 18 or over and accepts responsibility for the Equipment throughout the hire period.
1.3 You must provide accurate contact, delivery and event information when making your booking.
1.4 The Equipment remains the property of CADENCE CAMPS at all times. Hiring the Equipment does not transfer ownership to you.
2. Hire Period
2.1 The Equipment may only be used during the agreed hire period stated on your booking.
2.2 The Equipment must be available for collection or returned at the agreed time and location.
2.3 If the Equipment is not available for collection at the agreed time, additional charges may apply where this results in additional travel, collection or loss of another booking.
2.4 You must not move the Equipment to another address or location without our prior permission.
3. Safe Use & Supervision
3.1 You are responsible for ensuring that the Equipment is used safely and correctly throughout the hire period.
3.2 The Equipment must only be operated by a responsible adult aged 18 or over.
3.3 Children must not operate the Equipment.
3.4 The Equipment must never be left operating unattended.
3.5 You must follow all operating instructions provided with the Equipment.
3.6 The Equipment must be placed on a stable, level and suitable surface and positioned in a safe location away from hazards, excessive moisture, water and areas where it may be knocked over.
3.7 Electrical Equipment must be connected to a suitable and safe electrical supply. You must not use damaged plugs, cables, extension leads or electrical sockets.
3.8 The Equipment must not be used outdoors in rain or other unsuitable weather conditions unless we have specifically confirmed that the Equipment is suitable for the conditions.
3.9 You must not attempt to repair, modify, dismantle or alter the Equipment.
3.10 You must immediately stop using the Equipment and contact us if it becomes damaged, unsafe, overheats, produces unusual smells or sounds, or otherwise appears to be malfunctioning.
4. Damage to Equipment
4.1 You are responsible for taking reasonable care of the Equipment during the entire hire period.
4.2 You may be charged for damage caused by misuse, negligence, accidental damage, improper cleaning, failure to follow instructions, unauthorised modification or any other damage beyond reasonable wear and tear.
4.3 Examples of chargeable damage may include, but are not limited to:

Broken or cracked components;

Damaged switches, controls, handles or doors;

Damage to electrical cables, plugs or electrical components;
-
Damage caused by liquids or excessive moisture;
-
Damage caused by food, sugar or other materials being used incorrectly;
-
Damage caused by dropping, tipping over or moving the Equipment incorrectly;
-
Damage caused by attempting to repair or modify the Equipment;
-
Missing parts or accessories;
-
Damage caused by using unsuitable ingredients or materials; and
-
Damage caused by failing to clean the Equipment as instructed.
4.4 If Equipment is returned damaged, we will assess the damage and may charge the reasonable cost of repair or replacement.
4.5 Where possible, we will provide evidence of the damage and/or the repair or replacement cost.
4.6 You will not be charged for normal wear and tear arising from reasonable use of the Equipment.
5. Loss or Theft
5.1 You are responsible for the Equipment while it is in your possession or under your control.
5.2 The Equipment must be kept in a secure location when not in use.
5.3 You must take reasonable steps to prevent the Equipment from being lost, stolen or removed without permission.
5.4 If the Equipment is lost, stolen or cannot be returned, you may be responsible for the reasonable replacement cost of the Equipment and any associated accessories.
5.5 If the Equipment is stolen, you must notify us immediately and, where appropriate, report the theft to An Garda Síochána and provide us with the relevant incident/reference number.
6. Cleaning & Food Hygiene
6.1 You are responsible for using the Equipment in a clean and hygienic manner.
6.2 Only suitable ingredients and materials should be used in the Equipment.
6.3 Excessive cleaning is not necessary, as we will clean the equipment after each booking. However if cleaning is necessary for use, please only use warm water and dish soap.
6.4 Excessive food residue, sugar build-up or other contamination resulting from improper use may result in an additional cleaning or repair charge.
6.5 The Equipment must not be submerged in water or cleaned in a manner that could damage electrical components.
7. Cancellation Policy
7.1 We understand that plans can change. Cancellations made more than 48 hours before the agreed hire date may be eligible for a refund, subject to the terms of your booking and any reasonable costs already incurred by us.
7.2 Cancellations made less than 48 hours before the agreed hire date are non-refundable, except where you have a legal right to a refund or where we agree otherwise at our discretion.
7.3 If you fail to attend, are unavailable for delivery/collection, or otherwise do not proceed with the hire on the agreed date, this will generally be treated as a cancellation within 48 hours and no refund will be provided, subject to your statutory rights.
7.4 If we are unable to provide the Equipment you have booked, we will contact you as soon as reasonably possible and, where we cannot provide a suitable alternative, provide an appropriate refund in accordance with applicable consumer law.
7.5 Nothing in these Terms & Conditions affects any statutory cancellation, refund or other consumer rights that you may have under Irish law.
8. Delivery & Collection
8.1 Where delivery and collection are included, you must ensure that someone responsible is available at the agreed location and time.
8.2 You must provide clear and accurate delivery instructions, including any access restrictions, parking information, stairs or other relevant information.
8.3 You are responsible for informing us of any circumstances that may make delivery or collection difficult or unsafe.
8.4 Additional charges may apply where we are unable to deliver or collect the Equipment because of incorrect information, lack of access, nobody being available, or circumstances within your control.
9. Faults & Equipment Problems
9.1 We will make reasonable efforts to ensure that the Equipment supplied is clean, safe and in working order.
9.2 If you experience a problem with the Equipment, you must contact us as soon as possible so that we can attempt to resolve the issue.
9.3 You must not attempt to repair the Equipment yourself or arrange for another person to repair it without our permission.
9.4 If the Equipment develops a fault that is not caused by your misuse, negligence or failure to follow the instructions, we will take reasonable steps to resolve the issue.
9.5 Nothing in these Terms & Conditions limits your legal rights where the service or Equipment does not meet the requirements of applicable Irish consumer law.
10. Prohibited Use
The Equipment must not be:

Used for any illegal purpose;
-
Used by children without direct adult supervision;
-
Used in unsafe or hazardous conditions;
-
Used while damaged or malfunctioning;
-
Modified or tampered with;
-
Used with unsuitable ingredients or materials;
-
Used in a way that could cause injury or damage to property; or
-
Removed from the agreed hire location without our permission.
11. Responsibility for Guests & Third Parties
11.1 If the Equipment is being used at a party, event or gathering, you are responsible for ensuring that guests, children and other persons do not misuse or interfere with the Equipment.
11.2 You remain responsible for damage caused by guests or other persons using or accessing the Equipment during your hire period.
12. Liability
12.1 You are responsible for using the Equipment safely and in accordance with the instructions provided.
12.2 To the extent permitted by law, we are not responsible for loss or damage resulting from your misuse, negligence, failure to follow instructions or unauthorised use of the Equipment.
12.3 Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under Irish law, including liability for death or personal injury caused by our negligence or any other liability that the law does not permit us to exclude.
13. Damage Charges & Outstanding Amounts
13.1 If damage, loss, theft, missing accessories, excessive cleaning or other chargeable costs arise, we will notify you of the amount due.
13.2 You agree to pay any reasonable amount properly due under these Terms & Conditions.
13.3 Where a deposit or security payment has been taken, we may use it towards amounts properly due, and any remaining balance will be refunded to you.
13.4 Any damage or replacement charge will be based on the reasonable cost of repair, cleaning or replacement rather than being used as a penalty.
14. Photographs & Condition of Equipment
14.1 We may photograph or record the condition of Equipment before and after hire for the purpose of documenting its condition.
14.2 Photographs may be used as evidence when assessing damage, missing parts or excessive cleaning requirements.
15. Changes to Bookings
15.1 Requests to change the date, time, location or Equipment included in a booking must be agreed with us in advance.
15.2 We will do our best to accommodate reasonable requests but cannot guarantee that changes will always be possible.
16. Weather & Outdoor Events
16.1 If Equipment is being used outdoors, you are responsible for ensuring that it is protected from unsuitable weather conditions.
16.2 The Equipment must not be exposed to rain, standing water or other conditions that could create a safety risk or damage the Equipment.
16.3 If severe weather makes the use or delivery of the Equipment unsafe, we may need to cancel, postpone or modify the booking. Where this occurs, we will discuss the available options with you.
17. Acceptance of Terms
By checking the box confirming acceptance of these Terms & Conditions at checkout, you confirm that:

You are aged 18 or over;

You have read and understood these Terms & Conditions;

You accept responsibility for the Equipment during the hire period;

You agree to use the Equipment safely and in accordance with the instructions;

You understand the cancellation policy;

You understand that you may be charged for reasonable repair, replacement, cleaning or loss costs resulting from damage, misuse, negligence, loss or theft; and
-
You understand that these Terms & Conditions do not remove or restrict any statutory rights you have under Irish law.
18. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Ireland.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
